On any given day, more than 440,000 children are in foster care in the United States. These children desperately need safe and loving homes. But now, in a move that will further limit the number of homes, our government has proposed a rule to roll back anti-discrimination provisions in taxpayer-funded programs through the Department of Health and Human Services.

There is no room for discrimination in government programs. The proposed new rule would allow child welfare agencies to reject prospective foster or adoptive parents because of their sexual orientation, gender identity or expression, religion, and other factors. In practice, this would allow child welfare agencies to discriminate against same-sex couples and Jews, Muslims, Catholics, and others of minority faiths, as has happened in South Carolina, solely on the basis of religious belief. Faith-based providers play a valuable role in providing services for children in foster care across the country, but this does not give them a license to discriminate.
